Under and by virtue of the power of sale contained in that certain Security Deed and Assignment of Rents, from AGA Real Estate Security, LLC (“Grantor”), to and in favor of Mortgage Registration Systems, Inc. (“MERS”) as grantee, as nominee for Dominion Financial Services, LLC (“Original Lender”), dated July 22, 2024, recorded August 1, 2024 at Deed Book 2280, Page 79, Troup County, Georgia records; as a to Dominion Financial Services, LLC (“Lender”) by that certain Assignment, recorded December 31, 2025 at Deed Book 2363, Page 93, aforesaid, Georgia records (the “Security Deed”) securing that certain Commercial Promissory Note, dated July 22, 2024, in the original principal amount of $1,475,

Gallant subdivision, as shown on that certain plat of survey for said subdivision recorded in Plat Book 10, Pages 1-2, Troup County, Georgia Deed Records; and more particularly described as Lot 47 on that certain plat of survey prepared by Andrew M. Camp, GRLS 2978, dated December 20, 2006, entitled “Survey for Jeffrey R. Anderson”, as recorded in Plat Book 731 Page 31, Troup County, Georgia Deed Records; said plats being incorporated herein and made a part hereof for the purpose of a more complete and accurate description.

Together with all appurtenances and hereditaments thereof, but subject to all legal highways, restrictions of record, and zoning laws.

Said lot is known as 616 DeGroat Street according to the present numbering system of the City of LaGrange, Georgia.

All that tract or parcel of land situate, lying and being in the City of LaGrange, Troup County, Georgia, and more particularly described as the South 1/2 of LOT 54 according to a plat recorded in Plat Book 1, Page 77, Troup County Records, which said plat is hereby adopted and made a part of this description as completely as if the metes and bounds were fully set forth and delineated herein.

All that tract or parcel of land. lying and being in the City of LaGrange and County of Troup, State of Georgia, and designated as Lot Number 6 in Block “G” of the LaGrange Heights Subdivision, as shown by plat of said property recorded in Deed Book 6, page 792 and 793, Troup County Records, said lots fronting on Fendig Street a distance of 50 feet each and running back an equal distance of 150 feet, and having thereon frame house known and numbered as # 104 Fendig Street, and being the same property as conveyed to Jack Moskowitz and Ben Grabolowky by Warranty Deed dated June 22, 1943, and recorded in Deed Book 51, Page 562, Troup County Records. Plat of said property is referred to and made a part of this description.

All that tract or parcel of land lying and being, in the City of LaGrange, Troup County, Georgia and being Lot Number Four (4) of the Bruce Milam property as shown by a plat, which plat is recorded in the Office of the Clerk of the Superior Court of Troup County, Georgia in Plat Book 9, Page 2. Said plat is here referred to for a more complete description of said property.

All that tract or parcel of land lying and being in the City of LaGrange, Troup County, Georgia in the Northern part of said City and known as Lot No. 3 of the Roy Dallis survey as shown by a map of the land of A.T. Dallis, said map recorded in the Office of the Clerk of the Superior Court of said county in Deed Book 3, Page 268, Troup County, Georgia Deed Records. Said lot faces New Street East One Hundred and Sixty-six and one-half (166 1/2) feet, and being Eighty-five (85) feet deep at the south side and eighty-three (83) feet deep on the north side and one-hundred and sixty-six and one-half (166 1/2) feet on the west side except fifty (50) front on the south end of said lot running back an equal distance a depth of eighty four (84) feet which has been sold off of said Lot No. 3.
Also, all that tract or parcel of land to wit: lying and being in the northern part of the City of LaGrange, Troup County, Georgia, and being fifty (50) feet off the south end of Lot No. 1 as shown by a plat of A.T. Dallis lots, recorded in Book 3, Page 268 of records of Clerk of Superior Court, Troup County, Georgia, said parcel of land more fully described as follows: Beginning at the southeast corner of said Lot No.; 1 on west side of street and running thence west along south line of said Lot No. 1 for a distance of eighty-three (83) feet; thence north (50) feet; thence east eighty-three (83) feet more or less to the street; thence’, south fifty (50) feet along west line of street to the beginning point. The above-described property was conveyed by Warranty Deed from Mallory Realty Company Inc. to Julian Strickland dated June 24, 1969, and recorded July 1, 1969, in Deed Book 233, page 23, Troup County, Georgia Deed Records. Said property is known and distinguished as 105 Stuart Street by the present numbering system of the City of LaGrange, Troup County, Georgia.

All that certain lot or parcel of land, with improvements thereon, lying and being in Land Lot 142 of the 6th Land District, City of LaGrange, Troup County, Georgia, located on Third Avenue in LaGrange, Georgia, and being Lot 7 in Block 20 Callaway Community Foundation Subdivision as shown by plat recorded in the Office of the Clerk of the Superior Court of Troup County, Georgia in Plat Book 2, Pages 103 - 104, Troup County, Georgia Deed Records; further described on that certain plat of survey prepared by J. Hugh Camp &GRLS 939, dated October 1, 1979, entitled “The Property of Willie John & Frances Byrd”, as recorded in Plat Book 21, Page 110, Troup County, Georgia Deed Records; said plats being incorporated herein and made a part hereof for the purpose of a more complete description. It is covenanted and agreed that the property shall only be used for residence purposes and that this is a covenant running with the land.

The indebtedness evidenced by the Note is due and payable and remains unpaid. The Security Deed therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Security Deed.
The Premises will be sold on an “as is, where is” basis without recourse against Lender and without representation or warranty of any kind or nature whatsoever by Lender with respect thereto.
The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorneys’ fees (notice of intention to collect attorneys’ fees having been given), then to the payment of all sums secured by the Security Deed, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Note and Security Deed. The Premises shall be sold as the property of Grantor, subject to all restrictions, easements and other matters of record that are prior to the Security Deed and to which the Security Deed is subject and to any unpaid city, county and state ad valorem taxes or assessments relating to the Premises.
