NOTICE OF SUMMONS
TO: EDWARD CASH DENNIS, all males of the world, and any and all other persons with a parental interest in the above child.
NOTICE OF EFFECT OF TERMINATION JUDGMENT
Georgia law provides that you can permanently lose your rights as a parent. A petition to terminate parental rights has been filed on the 14 day of March 2023, requesting the court to terminate your parental rights to your child.
The grounds alleged in the termination of parental rights petition include: (a) that the mother and father have subjected the child to aggravated circumstances; (b) that the mother and father have abandoned the child; and (c) that the child is a dependent child due to lack of proper parental care or control by the parents, reasonable efforts to remedy the circumstances have been unsuccessful or were not required, such cause of dependency is likely to continue or will not likely be remedied in the reasonably foreseeable future, and (i) Returning the child to the parents is likely to cause serious physical, mental, moral, or emotional harm to the child or threaten the physical safety or well-being of the child; or (ii) Continuation of the parent and child relationship will cause or is likely to cause serious physical, mental, moral, or emotional harm to the child.
A copy of the petition to terminate parental rights may be obtained by contacting the clerk of court at (706) 883-1735. A court hearing of your case has been scheduled for the 7th day of June 2023, at 8:30 AM at the Juvenile Court of Troup County, located at 118 Ridley Avenue, LaGrange, GA 30240. If you fail to appear, the court can terminate your rights in your absence.
If the court at the trial finds that the facts set out in the petition to terminate parental rights are true and that termination of your rights will serve the best interests of your child, the court can enter a judgment ending your rights to your child.
If the judgment terminates your parental rights, you will no longer have any rights to your child. This means that you will not have the right to visit, contact, or have custody of your children or make any decisions affecting your child or your child’s earnings or property. Your child will be legally freed to be adopted by someone else.
Even if your parental rights are terminated:
(1) You will still be responsible for providing financial support (child support payments) for your child’s care unless and until your child are adopted; and
(2) Your child can still inherit from you unless and until your child is adopted.
This is a very serious matter. You have the right to hire an attorney and to have him or her represent you. If you cannot afford to hire an attorney, the court will appoint an attorney if the court finds that you are an indigent person. Whether or not you decide to hire and attorney, you have the right to attend the hearing of your case, to call witnesses on your behalf, and to question those witnesses brought against you.
Notice to Biological Fathers who are not Legal Fathers:
Pursuant to O.C.G.A. §15-11-283(c), the biological father who is not the legal father is hereby notified that he will lose all rights to the child named in this petition and will not be entitled to object to termination of his parental rights to his child unless, within thirty (30) days of his receipt of notice he files:
(1) a petition to legitimate such child; and
(2) notice of filing of the petition to legitimate with the Juvenile Court of Troup County, in which action is pending.
Pursuant to O.C.G.A. §15-11-283(e), said biological father is also notified that the court may enter an order terminating all the parental rights of a biological father, including any right to object thereafter to such proceedings:
(1) who fails to file a timely petition to legitimate the child named in a petition brought pursuant to this article and notice in accordance with subsection (c) of this Code Section; (2) Whose petition to legitimate is subsequently dismissed for failure to prosecute; or
(3) Whose petition to legitimate does not result in a court order finding that he is the legal father of the child named in a petition brought pursuant this article.
